This appeal by assessee is directed against the order of ld. Commissioner of Income tax-3, Vadodara dated 10.12.2018 for Assessment Year 2010-11, which in turn arises out assessment order passed by the Assessing Officer under section 143(3) of the Income Tax Act, 1961 dated 20.03.2013 for assessment year 2010- 11. 2. At the time of hearing, Ld. Authorized Representative (AR) submits that assessee has filed an application for withdrawal of his appeal. Therefore, he may be allowed to withdraw assessee’s appeal. 3. On the other hand, Ld. Senior Departmental Representative (Sr DR) appearing on behalf of Revenue submits that she has no objection, if the appeal of assessee is dismissed as withdrawn. 4. We have considered the submissions of both the parties and considering the written request of assessee, and no objection of Ld. ITA No.19/SRT/2019 Sh. Rajeshkumar K Shah 2 Sr-DR for the revenue, the appeal of assessee is dismissed as withdrawn. 5. In the result, the appeal of the assessee is dismissed as withdrawn. Order pronounced in the open court at the time of hearing of appeal on 14 th March 2022 in the Virtual Court hearing.
