Assessee vide its letter prayed for withdrawal of appeal in ITA No. 4538/Mum/2023 for A.Y.2014-15. For the sake of ITA No. 4538/Mum/2023 Play Games 24X7 Pvt. Ltd. 2 convenience, we are reproducing the contents of the said Application as under:- “The Appellant Company had filed an appeal against the order passed by the Principle Commissioner of Income Tax ('PCIT'), Mumbai-5 under Section 263 of the Income-tax Act, 1961 (the 'Act") on December 13, 2023 for the captioned year. The hearing for the said appeal is fixed on May 1, 2024. In relation to the appeal filed, the Appellant Company is requesting for the withdrawal of the said appeal as the Appellant Company would wish to continue with the regular revision proceedings and submit the data as required by the officer and further contest it on merit, if required. You are requested to accept the Appellant Company's request for withdrawal of the appeal pending before this Hon'ble Bench. We request you to please let us know if any further details/clarification is required, we shall be happy to provide the same. We request you to kindly acknowledge receipt and oblige. 3. Ld. DR has not raised any objection. 4. We have heard the ld. DR and perused the records, especially the Application of assessee for withdrawal of the Appeal. We find considerable cogency in the contentions of Assessee as aforesaid. Keeping in view of the facts and circumstances of the case, we accept the request of the assessee for withdrawal of the Appeal and accordingly, we dismiss the Appeal as withdrawn.
