When the matter was called for hearing, it is noticed that the ld.counsel for the assessee, Shri Mahesh Varjani Shah, has filed a letter dated 3.11.201 enclosing therewith copy form no.3 for settlement of tax dispute with the Department under Direct Tax Vivad Se Vishwas Act, 2020. The assessee accordingly seeks withdrawal of appeal to facilitate her to avail the benefit under the same scheme. The letter of the counsel and copy of form no.3 are taken on record. In this view of the matter, the ld.counsel for the assessee seeks withdrawal of ITA No.628/Ahd/2018 2 the appeal. The ld.DR has no objection if the appeal is treated to be withdrawn in view of the submission of the assessee. 3. In the light of the above letter of the ld.counsel for the assessee, I find no reason to keep pending appeal of the assessee before the Tribunal because as per form no.3 submitted by the assessee before the competent authority, the assessee wanted to settle the tax dispute with the department. Accordingly, appeal of the assessee is dismissed as withdrawn. 4. In the result, the appeal of the assessee stands dismissed under VSV scheme.
