When the matter was called for hearing, it was intimated by the ld.counsel for the assessee that he has instruction to withdraw this appeal pending before the Tribunal, and therefore, he seeks withdrawal of the same. In view of this oral submission of the ld.counsel for the assessee at Bar, appeal of the assessee stands dismissed as being withdrawn. 3.
