Aforesaid appeal by assessee for Assessment Year (AY) 2016-17 arises out of the final assessment order dated 13-04-2021 passed by National e-Assessment Centre, Delhi pursuant to the directions of Hon’ble Dispute Resolution Panel-2, Bengaluru u/s. 144C(5) of the Act dated 23-03-2021. IT(TP)A No.31Chny/2021 - 2 - 2. The Registry has noted the delay of 02 days in the appeal which stand condoned considering the period of delay. 3. At the time of hearing, none appeared for the assessee. However, Ld. CIT-DR drew attention to the assessee’s letter dated 02.02.2022 and submitted that the assessee has entered into Advance Pricing Agreement (APA) with CBDT on 24.11.2021 which cover this year also. In the letter, it has also been submitted that ground Nos.1 to 10 of the appeal are related with Transfer Pricing adjustments which do not require adjudication in the light of APA agreement as aforesaid. 4. Considering the same, we remit the matter of assessment back to the file Ld. AO to pass consequential assessment order pursuant to the APA entered into by the assessee with the CBDT. 5. The appeal stands allowed for statistical purposes. Order pronounced on 07 th July, 2022.
