Thereafter the petitioner was served with notice dated 26.05. under Section 148A(b) 2015-2016 in view of the Supreme Court in ONLINE SC 543 Tax Act, 1961 was issued for the Assessment Year 2015 the judgment of Hon’ble Supreme Court dated 04.05.2022 Others Vs. Ashish Aggarwal notice under Section 148 of the Income Tax Act, 1961 for the Assessment Year 2015-2016 was issued to the petitioner. Petitioner filed reply to the same. On 02.11.2022, intimation was sent to the assessee for completion of assessment i accordance with the procedure under Section 144B of the Income Tax Act, 1961. Notice dated 27.01.2023 under Section 142(1) of the Income Tax Act, 1961 was issued to the petitioner. under the Income T Assessment Year 2015 bank account of the assessee to the tune of Rs.2,18,60,116/ unexplained and added to his income under 1961 to be taxed as per Section 115BB 2024 (O&M) issued on 27.11.2021 for the Assessment Year 2015 was transferred to NeFAC and to ReFAC on 08.12.2021. Therefore again notice under Section 142(1) of the Income Tax Act, 1961 Another show cause notice dated 19.03.2022 with draft assessment order to the petitioner. Reply to the same was submitted by the petitioner on 23.03.2022. Thereafter the petitioner was served with notice dated 26.05. under Section 148A(b) of the Income Tax Act, 1961 2016 in view of the judgment dated 04.05.2022 passed by the Hon’ble Supreme Court in Union of India and Others Vs. Ashish Aggarwal ONLINE SC 543. On 27.07.2022, notice under Section 148A Tax Act, 1961 was issued for the Assessment Year 2015 the judgment of Hon’ble Supreme Court dated 04.05.2022 Others Vs. Ashish Aggarwal [2022] SCC ONLINE SC 543 notice under Section 148 of the Income Tax Act, 1961 for the Assessment Year 2016 was issued to the petitioner. Petitioner filed reply to the same. On 02.11.2022, intimation was sent to the assessee for completion of assessment i accordance with the procedure under Section 144B of the Income Tax Act, 1961. Notice dated 27.01.2023 under Section 142(1) of the Income Tax Act, 1961 was issued to the petitioner. Thereafter, after following the procedure as laid down under the Income Tax Act, 1961, assessment order dated 26.05.2023 for the Assessment Year 2015-2016 was passed vide which the total credited entries in the bank account of the assessee to the tune of Rs.2,18,60,116/ unexplained and added to his income under Section 69A of the Income Tax Act, 1961 to be taxed as per Section 115BBE of Income Tax Act, 1961. -2- for the Assessment Year 2015-2016 and thereafter, the case was transferred to NeFAC and to ReFAC on 08.12.2021. Therefore again notice of the Income Tax Act, 1961 was issued on 22.12.2021. Another show cause notice dated 19.03.2022 with draft assessment order was . Reply to the same was submitted by the petitioner on 23.03.2022. Thereafter the petitioner was served with notice dated 26.05.2022 of the Income Tax Act, 1961 for the Assessment Year judgment dated 04.05.2022 passed by the Hon’ble Union of India and Others Vs. Ashish Aggarwal [2022] SCC notice under Section 148A(d) of the Income Tax Act, 1961 was issued for the Assessment Year 2015-2016 in consequence to the judgment of Hon’ble Supreme Court dated 04.05.2022 in Union of India and [2022] SCC ONLINE SC 543. On 27.07.2022 itself notice under Section 148 of the Income Tax Act, 1961 for the Assessment Year 2016 was issued to the petitioner. Petitioner filed reply to the same. On 02.11.2022, intimation was sent to the assessee for completion of assessment i accordance with the procedure under Section 144B of the Income Tax Act, 1961. SUBMISSIONS Learned counsel for the petitioner contends That since notice dated 27.07.2022 issued under Section 148 of the Income Tax Act, 1961 was barred by limitation in view of the coming into force of Finance Act, 2021, therefore the assessment order under Section 147 of the Income Tax Act, 1961 dated 26.05. in the eyes of law. Further, that controversy in the present writ petition is already settled by the Hon’ble Supreme Court in the case of Vs. Rajeev Bansal [2024] 469 ITR 46 (SC) Therefore, the present writ petition be allowed in terms of the settled proposition of law in the case of Union of India Vs. Rajeev Bansal (Supra). earned counsel for the respondent proposition of law as settled by Hon’ble Supreme Court (Supra), by which the case of the petitioner is covered. Rajeev Bansal [2024] 469 ITR 46 (SC) on 03.10.2024. Therefore, the present writ petition be allowed in terms of the settled Union of India Vs. Explanation 1.-Production before the Assessing Officer of account books or other evidence from which material evidence could with due diligence have been discovered by the Assessing Officer will not necessarily amount to disclosure within the meaning of the foregoing proviso. (b) where a return of income has been furnished by the assessee but no assessment has been made and it is noticed by the Assessing Officer that the assessee has understated the income or has claimed excessive loss, deduction, allowance or relief in the return; (ba) where the assessee has failed to furnish a report in respect of any international transaction which he was so required under section 92E; (c) where an assessment has been made, but (i) income chargeable to tax has been underassessed; or (ii) such income has been assessed at too low a rate; or (iii) such income has been made the subject of excessive relief under this Act; or (iv) excessive loss or depreciation allowance or any other allowance under this Act has been computed; (ca) where a return of income has not been furnished by the assessee or a return of income has been furnished by him and on the basis of information or document received from the prescribed income-tax authority, under sub section 133C, it is noticed by the Assessing Officer that the income of the assessee ex -6- other person in respect of which he is assessable under this Act during the previous year exceeded the maximum amount which tax; (b) where a return of income has been furnished by the ssessment has been made and it is noticed by the Assessing Officer that the assessee has understated the income or has claimed excessive loss, deduction, allowance or (ba) where the assessee has failed to furnish a report in respect of any international transaction which he was so required (c) where an assessment has been made, but- (i) income chargeable to tax has been underassessed; or (ii) such income has been assessed at too low a rate; or (iii) such income has been made the subject of excessive relief (iv) excessive loss or depreciation allowance or any other allowance under this Act has been computed; (ca) where a return of income has not been furnished by the or a return of income has been furnished by him and on the basis of information or document received from the tax authority, under sub-section (2) of section 133C, it is noticed by the Assessing Officer that the income of the assessee exceeds the maximum amount not other person in respect of which he is assessable under this Act during the previous year exceeded the maximum amount which (b) where a return of income has been furnished by the ssessment has been made and it is noticed by the Assessing Officer that the assessee has understated the income or has claimed excessive loss, deduction, allowance or (ba) where the assessee has failed to furnish a report in respect of any international transaction which he was so required (iii) such income has been made the subject of excessive relief (iv) excessive loss or depreciation allowance or any other (ca) where a return of income has not been furnished by the or a return of income has been furnished by him and on the basis of information or document received from the section (2) of section 133C, it is noticed by the Assessing Officer that the ceeds the maximum amount not TRIPTI SAINI 2025.04.11 09:48 I attest to the accuracy and integrity of this document CWP-4112-2024 Explanation 3. this section, the Assessing Officer may assess or reassess the income in respect of any issue, which has escaped assessment, and such issue comes to his notice subsequently in the course of the proceedings under this section, notwithstanding that the reasons for such issue have not been included in the reasons recorded under subsection (2) of section 148. Explanation 4. the provisions of this section, as amended by the Finance Act, 2012, shall also be applicable for any assessment year beginning on or before the 1st day of April, 2012. Issue of notice where income has escaped assessment 148. recomputation under section 147, the Assessing Officer shall serve on the assessee a notice requiring him to furnish within such period, as may be specified in the notice, a return of his income or the inc any other person in respect of which he is assessable under this Act during the previous year corresponding to the relevant assessment year, in the prescribed form and verified in the prescribed manner 2024 (O&M) chargeable to tax, or as the case may be, the assessee has understated the income or has claimed excessive loss, deduction, allowance or relief in the return; (d) where a person is found to have any asset (including financial interest in any entity) located outside India. Explanation 3.-For the purpose of assessment or reassessment under this section, the Assessing Officer may assess or reassess the income in respect of any issue, which has escaped assessment, and such issue mes to his notice subsequently in the course of the proceedings under this section, notwithstanding that the reasons for such issue have not been included in the reasons recorded under subsection (2) of section 148. Explanation 4.-For the removal of doubts the provisions of this section, as amended by the Finance Act, 2012, shall also be applicable for any assessment year beginning on or before the 1st day of April, 2012. Issue of notice where income has escaped assessment 148. (1) Before making the assessment, reassessment or recomputation under section 147, the Assessing Officer shall serve on the assessee a notice requiring him to furnish within such period, as may be specified in the notice, a return of his income or the inc any other person in respect of which he is assessable under this Act during the previous year corresponding to the relevant assessment year, in the prescribed form and verified in the prescribed manner -7- chargeable to tax, or as the case may be, the assessee has understated the income or has claimed excessive loss, deduction, allowance or relief in the return; (d) where a person is found to have any asset (including nterest in any entity) located outside India. It cannot be disputed that by substitution of sections 147 to 151 of the Income Tax Act (IT Act) by the Finance Act, 2021, radical and reformative changes are made governing the procedure for reassessment proceedings. Amended sections 147 to 149 and sect 151 of the IT Act prescribe the procedure governing initiation of reassessment proceedings. However, for several reasons, the same gave rise to numerous litigations and the reopening were challenged inter alia, on the grounds such as (1) no valid \"reas no tangible/reliable material/information in possession of the assessing officer leading to formation of belief that income has escaped assessment, (3) no enquiry being conducted by the assessing officer prior to the issuance of notice; change of opinion of the assessing officer and (4) lastly the mandatory procedure laid down by this Court in the case of (India) Ltd. v. Income Tax Officer and ors; (2003) 1 SCC 72 not been followed. 6.1 Further pre-Finance Act, 2021, the reopening was permissible for a maximum period up to six years and in some cases beyond even six years leading to uncertainty for a considerable time. The Revenue cannot be made remediless and the object and purpose of reassessment proceedings cannot be frustrated. It is true that due to a bonafide mistake and in view of subsequent extension of time vide various notifications, the Revenue issued the impugned notices under section 148 after the amendment was enforced w.e.f. 01.04.2021, under the unamended section 148. Therefore, we propose to modify the judgments and orders passed by 2024 (O&M) issued under the unamended Act and ought to have been issue the substituted provisions of sections 147 to 151 of the IT Act as per the Finance Act, 2021. The respective assessing officers shall within thirty days from today provide to the assessees the information and material relied upon by the Revenue so that the assessees can reply to the notices within two week (ii) The requirement of conducting any enquiry with the prior approval of the specified authority under section 148A(a) be dispensed with as a one-time measure vis which have been issued under Section 148 of the unamended Act from 01.04.2021 till date, including those which have been quashed by the High Courts; (iii) The assessing officers shall thereafter pass an order in terms of section 148A(d) after following the due procedure as required under section 148A(b) in respe concerned assessees; (iv) All the defences which may be available to the assessee under section 149 and/or which may be available under the Finance Act, 2021 and in law and whatever rights are available to the Assessing Officer under the open and/or shall continue to be available and; (v) The present order shall substitute/modify respective judgments and orders passed by the respective High Courts quashing the similar notices issued under unamended section -25- 2021 and treated to be show-cause notices in terms of section 148A(b). The respective assessing officers shall within thirty days from today provide to the assessees the information and material relied upon by the Revenue so that the assessees can reply to the notices within two weeks thereafter; (ii) The requirement of conducting any enquiry with the prior approval of the specified authority under section 148A(a) be time measure vis-a-vis those notices which have been issued under Section 148 of the unamended Act from 01.04.2021 till date, including those which have been quashed by the High Courts; (iii) The assessing officers shall thereafter pass an order in terms of section 148A(d) after following the due procedure as required under section 148A(b) in respect of each of the (iv) All the defences which may be available to the assessee under section 149 and/or which may be available under the Finance Act, 2021 and in law and whatever rights are available to the Assessing Officer under the Finance Act, 2021 are kept open and/or shall continue to be available and; (v) The present order shall substitute/modify respective judgments and orders passed by the respective High Courts quashing the similar notices issued under unamended section cause notices in terms of section 148A(b). Therefore, we have proposed to pass the present order with a view avoiding filing of further appeals before this Court and burden this Court with approximately 9000 appeals against the similar judgments Courts, the particulars of some of which are referred to hereinabove. We have also proposed to pass the aforesaid order in exercise of our powers under Article 142 of the Constitution of India by holding that the pres orders passed by the High Court of Judicature at Allahabad, but shall also be made applicable in respect of the similar judgments and orders passed by various High Courts across the country and therefore the present order shall be applicable to PAN INDIA. 2024 (O&M) 148 of the IT Act irrespective of whether they have been assailed before this Court or not. There is a broad consensus on the aforesaid aspects amongst the learned ASG appearing on behalf of the Revenue and the learned Senior Advocates/learned counsel appearing on behalf of the respective assessees. We are also of the opinion that if the aforesa order is passed, it will strike a balance between the rights of the Revenue as well as the respective assesses as because of a bonafide belief of the officers of the Revenue in issuing approximately 90000 such notices, the Revenue may not suffer as ulti exchequer which would suffer. Therefore, we have proposed to pass the present order with a view avoiding filing of further appeals before this Court and burden this Court with approximately 9000 appeals against the similar judgments and orders passed by the various High Courts, the particulars of some of which are referred to hereinabove. We have also proposed to pass the aforesaid order in exercise of our powers under Article 142 of the Constitution of India by holding that the present order shall govern, not only the impugned judgments and orders passed by the High Court of Judicature at Allahabad, but shall also be made applicable in respect of the similar judgments and orders passed by various High Courts across the country and erefore the present order shall be applicable to PAN INDIA. -26- of the IT Act irrespective of whether they have been assailed before this Court or not. Ashish Aggarwa SC 543l, Hon’ble the Supreme Court held that the impugned notices 148 issued to the respective asses 148 of the Income Tax Act and were subject matter of writ petitions before the various respective High Courts shall be deemed to have been issued under Section 148-A of the Income Tax Act as substituted by the construed or treated to be show cause notices in terms of Section 148A(b). It was further held that the Assessing Officer shall, within 30 days from the date of passing of the judgment i.e. 04.05.2022 information and material relied upon by the Revenue, so that the Assessees can reply to the show cause notices within 2 weeks thereafter. It was further held by the Hon’ble Supreme Court that the requirement of conducting any enquiry, if required, with the prior approval of specified authority under Section 148A(a) is dispensed with as one time measure viz under Section 148 of the unamended Act from 01.04.2021 2024 (O&M) High Courts in which similar notices under Section 148 of the Act issued after 01.04.2021 are under challenge. . The impugned common judgments and orders passed by the High Court of Allahabad and the similar judgments and orders passed by arious High Courts, more particularly, the respective judgments and orders passed by the various High Courts particulars of which are mentioned hereinabove, shall stand modified/substituted to the aforesaid extent only. Therefore, in above referred to judgment of Hon’ble Supreme Court Union of India and Others Vs. Ashish Aggarwa , Hon’ble the Supreme Court held that the impugned notices 148 issued to the respective assessees which were issued under unamended Section 148 of the Income Tax Act and were subject matter of writ petitions before the various respective High Courts shall be deemed to have been issued under Section A of the Income Tax Act as substituted by the construed or treated to be show cause notices in terms of Section 148A(b). These notices were challenged before several High Courts, who declared the notices to be invalid being time ba appropriate sanction of the specified authority. 12. In deal with the issue as to whether or not reassessment notices were issued within the time limits prescribed under the provisions of Income Tax Act 2024 (O&M) date i.e. 04.05.2022 (Decision in Ashish Aggarwal) Officer shall thereafter pass orders in terms of Section 148A(d) in respect of each of the concerned assessees and thereafter, after following the procedure as required under Section 148A may issue notice(s) under Section 148 (as substituted). On 11.05.2022 following the decision in Vs. Ashish Aggarwal, the Central Board of Direct Taxes issued instructions for the implementation of the decision in Ashish Aggarwal’s case (s clarified that the judgment in Ashish Aggarwal would apply to all the cases where extended reassessment notices were issued, irrespective of the fact whether such notices were challenged or not. These instructions further stated that “travel back in time to their original date when such notices were to be issued and then new Section 149 of the Income Tax Act is to be applied at that point.” The instructions further elaborated the mechanism for issuing notic under Section 148 of the new regime. The Assessing Officers accordingly after considering the replies furnished by the assessees passed orders under Section 148A(d) and subsequently notices under Section 148 of the new regime were issued to the assessees by the Assessing Officers for the Assessment Year 2013-2014, 2014 2018. These notices were challenged before several High Courts, who declared the notices to be invalid being time ba appropriate sanction of the specified authority. Ashish Aggarwal’s case (supra) deal with the issue as to whether or not reassessment notices were issued within the time limits prescribed under the provisions of Income Tax Act -30- sion in Ashish Aggarwal). Further that the Assessing Officer shall thereafter pass orders in terms of Section 148A(d) in respect of each of the concerned assessees and thereafter, after following the procedure as required under Section 148 (as substituted). the decision in Union of India and Others , the Central Board of Direct Taxes issued instructions for the Ashish Aggarwal’s case (supra), wherein it was clarified that the judgment in Ashish Aggarwal would apply to all the cases where extended reassessment notices were issued, irrespective of the fact whether such notices were challenged or not. These instructions further stated that reassessment “travel back in time to their original date when such notices were to be issued and then new Section 149 of the Income Tax Act is to be applied at that point.” The instructions further elaborated the mechanism for issuing notic under Section 148 of the new regime.
