PAN : AAJCS 6450L (अपीलाथᱮ/Appellant) (ᮧ᭜यथᱮ/Respondent) Ĥाथ[क कȧ ओर से /Petitioner by : Shri Sajit Kumar, JCIT Ĥ×यथȸ कȧ ओर से/Respondent by : Shri Sridhar, Advocate स ु नवाई कȧ तारȣख/ Date of hearing : 06.05.2022 घोषणा कȧ तारȣख /Date of Pronouncement : 06.05.2022 आदेश /O R D E R PER MAHAVIR SINGH, VP: By way of this Miscellaneous Application, Revenue has stated that the Tribunal order in ITA No.3373/Chny/2018 dated 21.10.2019, dismissing the appeal of Revenue on low tax effect, the Tribunal has committed a mistake as the assessment was framed in consequent to Revenue’s audit objection and hence, the assessee’s case falls under exception clause 10(c) of Board’s Circular No.17/2019 dated 08.08.2019 and hence, 2 M.A No.103/CHNY/2020 requested that the order of Tribunal may be recalled and appeal be heard on merits. 2. The ld. Senior DR as well as ld. counsel for the assessee agreed for recalling the order and deciding the appeal on merits. The copy of Revenue’s audit objection No.Pr.AG(C&RA)/ITRA-XXII/ITAs.No 07 dated 28-07-11 is kept on record. As the Tribunal’s order suffered from mistake apparent from record in view of clause 10(c) of Board’s Circular No.17/2019 dated 08.08.2019 and as there is a Revenue audit objection, the appeal should have been decided on merits. Hence, we recall the order of Tribunal in ITA No.3373/Chny/2018 dated 21.10.2019 and direct the Registry to fix this appeal for hearing on 17.05.2022. No further notice will be issued to either of the parties for hearing, as this was announced in open court. 3. In the result, the miscellaneous application of the Revenue is allowed.
