At the time of hearing, the ld. counsel of the assessee submitted that he is willing to withdraw the said miscellaneous application as there is no mistake in the order passed by the Tribunal in revenue’s appeal which has been decided in the favour of the assessee. On the other hand, the ld. DR left the issue to be decided at the wisdom of the bench. Accordingly, we dismiss application as withdrawn. 3. In the result, the miscellaneous application of the assessee is dismissed.
