The ld.Authorised Representative(ld.AR) of the assessee referred to affidavit as deposed by the assessee dated 09.08.2021 and submits that the Counsel as authorised by then, was confused to note down the date of next hearing in Virtual Mode and due to which the non-appearance on behalf of the assessee was caused before this Tribunal on the date of hearing i.e. 11.06.2021. He submits that the assessee is ready to prosecute his appeal if this Tribunal pleased to recall the ex-parte order. 3. The ld.Departmental Representative(ld.DR) for the Revenue did not report the objection in recalling the exparte order, therefore, considering the M.A.No.02/PUN/2022 (Arising out of ITA No.1869/PUN/2018) Late Shri Hukumchand Chunilal Bagmar L/h.Rajendra Hukumchand Bagmar for A.Y.2014-15 2 facts and circumstances of the case, in the interest of justice, we deem it proper to recall the order dated 17.06.2021 in Appeal No.1869/PUN/2018 and direct the registry to fix the appeal in regular course. 4. In the result, Miscellaneous Application of the assessee is allowed. Order pronounced in the open Court on 23 rd May, 2022.
