On perusal of Para No. 10, we discussed various factors other than the FOB in holding the Infobeans Systems Private Limited is not comparable and taking into consideration the order passed in earlier in the case of assessee held to exclude the Infobeans Systems Private Limited from the final set of comparable companies. Therefore, we find no substance in the Miscellaneous Application filed by the Revenue and it is fails. Thus, the Miscellaneous Application filed by the Revenue is dismissed. 3.
