However, the assessee has moved an application seeking permission to withdraw the Miscellaneous Application filed. 3. The counsel on 14.06.2022 submitted that the assessee seeks to withdraw the application filed. The counsel was given time to M.A.212/CHD/2018 In ITA 896/CHD/2017 Page 2 of 2 place written application stating so. Accordingly, on the next date, the counsel has stated as under : We have to very humbly submit that we had filed the above mentioned Misc. Application before the Hon'ble Bench and for which, the date of hearing has been fixed for 15 th of June, 2022 before Bench "A" of the Tribunal. It is submitted that we wish to withdraw the above said Misc. Application. It is, therefore, very humbly requested that the necessary permission for withdrawal of the said Misc. Application may, please, be granted and oblige 4. The ld. Sr.DR had no objection if the application filed by the assessee is dismissed as withdrawn. 5. In the light of the submissions of the parties before the Bench, the Miscellaneous Application filed by the assessee is dismissed as withdrawn. Order pronounced on 20 th June,2022.
