In the Miscellaneous Application, it has been submitted that in view of the decision of the Hon’ble Supreme Court in case of M/s Checkmate Services Pvt. Ltd. Vs. CIT-1 (Civil Appeal No. 2833 of 2016 dt. 12.10.2022), the order passed by the Tribunal needs to be recalled as held in the case of Asst. CIT Vs. Saurashtra Kutch Stock Exchange Ltd. [2008] 173 Taxman 322 wherein it was held that an order of assessment based upon an interpretation or application of law which is ultimately found to be wrong in light of jurisdictional pronouncement rendered subsequently discloses a mistake apparent from the record. It was accordingly, submitted that the present order so passed by the Coordinate Bench may be recalled and appeal of the Revenue be heard on merit after taking into consideration the decision of the Hon’ble Supreme Court in case of M/s Checkmate Services Pvt. Ltd. Vs. CIT-1(supra). 3. None appeared on behalf of the assessee. 2 4. In view of the decision of the Hon’ble Supreme Court referred supra, the order so passed by the Coordinate Bench is hereby recalled and the Registry is directed to fix the matter for hearing on 16/10/2023. Issue notice. 5. In the result, Miscellaneous Application filed by the Revenue is allowed.
