At the time of hearing of the Miscellaneous Petition, the ld. CIT-DR filed a letter dated 17.12.2021 requesting for not pressing the present Miscellaneous Petition. The relevant contents of the said letter is asunder :- “.......... 2. In this regard, it is submitted that the Pr.CIT-1, Nashik vide above referred letter dated 27/08/2021 has intimated that considering the current legal position and decision of the Hon'ble Supreme Court in the Pr.CIT Vs 2 MA No.39/PUN/2020 Golden Peace Hotels and Resorts (P) Ltd. (2021) 124 taxmann.com 249(SC), the outcome in the above case will not be fruitful and therefore, the case may not be pressed. ........” 3. Considering the submission of the ld. CIT-DR, ld. AR has no objection to withdraw the present Miscellaneous Petition, we allow the request of the ld. CIT-DR to not press the Miscellaneous Petition. 4.
