This miscellaneous application is filed by the Assessee in ITA No. 4335/Del/2014 dated 27.07.2017. 2. It has been submitted though the date of hearing was 27.07.207, the Assessee took the date of hearing as 07.08.207 and the Assessee accordingly informed his counsel, therefore, the assessee could not remain present on the date of hearing. An affidavit also sworn by the Assessee has been furnished along with miscellaneous application. It was submitted that the mistake is unintentional and bonafide and therefore, the order passed by the coordinate bench may be recalled. 3. The ld. DR vehemently opposed the miscellaneous application. Page | 2 4. We have carefully considered the rival contentions and perused the reason given by the assessee in the Miscellaneous Application which is supported by an affidavit and deem it to be a fit case to recall. 5.
