The assessee in the application has given the reason for non-appearance of the assessee on the scheduled date of hearing of the appeals. We are satisfied that non appearance of the assessee on the date of hearing of appeals was not deliberate but for the bonafide reasons as stated in the application. The Revenue has not been able to controvert the averments made in the application by the assessee. Taking into consideration entirety of facts we deem it appropriate to recall ex-parte order dated 25/01/2017 and restore the appeals to their original number. 3. The Registry is directed to fix the appeals for hearing on 23/06/2022. Since, the date of hearing of the appeals has been informed to both sides in the open Court, issuance of separate notice intimating date of hearing of the appeals is dispensed with. 4. In the result, Miscellaneous Applications filed by the assessee are allowed. Order pronounced in the open court on Friday the 27 th day of May, 2022.
