DURGA RAO, JUDICIAL MEMBER: The Revenue has filed the present Miscellaneous Petition against the order passed by the Tribunal in I.T.A. No. 1934/Mds/2016 dated 05.05.2022 relevant to the assessment year 2007-08. 2. By referring to the miscellaneous petition, the ld. DR has submitted the ITAT has dismissed the appeal of the Revenue on low tax effect. By giving a detailed tax computation, the ld. DR has submitted that the tax effect in the appeal filed by the Revenue is more than the monetary limit M.P. No.71/Chny/22 2 of ₹.50,00,000/- fixed by the CBDT and thus, pleaded for recalling the appeal for adjudication. 3. On the other hand, the ld. Counsel for the assessee fairly conceded the submissions of the ld. DR. 4. We have heard both the parties. We have also perused tax computation furnished by the Department and find that the tax effect in the appeal filed by the Revenue is more than the monetary limit of ₹.50,00,000/- fixed by the CBDT. Thus, we, hereby, recall the order of the Tribunal in I.T.A. No.1934/Chny/2016 dated 05.05.2022 and restore the same for fresh adjudication. Since hearing of the appeal fixed on 26.10.2022 has been pronounced in the open Court, no separate notice would be served on both the parties. 5.
