The petitioner has filed Ext.P4 appeal against Ext.P2 order of assessment before the National Faceless Appeal Centre. However the petitioner has not filed any stay petition before the National Faceless Appeal Centre. 2. It is the case of the learned counsel appearing for the petitioner that in the light of Ext.P7 judgment of this Court, the petitioner is not required to deposit the amount equivalent to 20% of the tax assessed as a condition for stay. 3. Heard the learned Standing Counsel appearing for the respondent department also. 4. Having heard the learned counsel appearing for the petitioner and the learned Standing Counsel appearing for the respondents, this writ petition is disposed of directing the respondents to provide a link to the petitioner for uploading W.P.(C)No.33451/2022 3 stay application in Ext.P4. This shall be done within a period of two weeks from the date of receipt of certified copy of this judgment. The petitioner shall file a stay application within 10 days from the date of receipt of the link. If such stay application is filed within the time stipulated above, recovery proceedings to recover any amount under Ext.P2 shall be kept in abeyance till a decision is taken on the stay application so filed by the petitioner. The Appellate Authority shall while deciding the stay petition also have regard to the findings of this Court in Ext.P7 judgment. The writ petition is disposed of as above. Sd/- GOPINATH P.
