Date of Hearing: 13.12.2024 Date of Pronouncement: 29.01.2025 O R D E R Per: Inturi Rama Rao, AM The present stay applications are filed by the assessee seeking stay of collection of the outstanding demands of Rs. 41,71,820/- & Rs. 6,99,230/- for assessment years (AYs) 2011-12 & 2012-13, respectively. 2. When the appeals were called, none appeared on behalf of the assessee nor is there any application for adjournment. Therefore, we proceed to dispose the appeals after hearing the learned Sr. DR. in the following terms: - From the material on record we find neither any prima facie case in favour of the assessee nor is there any material to show 9 SA Nos. 141 & 142/Coch/2023 & Others KK Leisure & Tourism International (P) Ltd.& Others that the applicant had complied with the terms and conditions specified in the second proviso to section 254(2)(a) of the Income Tax Act, 1961 (the Act), i.e. payment of 20% of the outstanding demand. Thus, the assessee failed to comply with the conditions precedent to grant of stay of demand. Under this circumstance, we are of the considered opinion that the stay petitions filed by the assessee deserve to be dismissed. Ordered accordingly. 3.
