Sarthi, AC to ASGI …... 06/ 06.07.2023. Apprehending his arrest, petitioner above-named has moved this Court for grant of anticipatory bail in connection with R.C. Case No.CBI/EOW/Ranchi RC0932017S0039 registered under Sections 406/ 408/ 419/ 420/ 468/ 471/ 472/ 120-B/ 34 of the Indian Penal Code. Heard the parties. It is submitted by learned counsel for the petitioner that the principal accused in this case is :- (1) M/s Bishal Distilleries Ltd. (Pvt. Company) (2) M/s Sitaran Projects Pvt. Ltd. (Pvt. Company), (3). M/s U. K. Fin Services Ltd. (Pvt. Company), (4) M/s Bishal Inn Pvt. Ltd. (Pvt. Company), (5) M/s Bishal Agri- Bio Industries Ltd. (Pvt. Company), (6) M/s Bishal Abasan India Ltd. (Pvt. Company), (7) M/s Bishal Horticulture & Animal Projects Ltd. (Pvt. Company) & (8) M/s Ganeshwani Construction Pvt. Ltd. (Pvt. Company) as well as others. It is submitted that these companies raised investments from the public at large on making false assurances of windfull return and after the maturity of debentures and other investments, the amount was not returned. It is submitted that the case was earlier registered by the Police and later on under the direction of this Court passed in W.P. (PIL) Nos.1635 of 2014 and 642 of 2016. After investigation, charge-sheet has been submitted against the company and its Directors and other persons including the petitioner. The main allegation against the petitioner is that he signed on some of the debenture certificates which were not paid to the beneficiaries after the maturity amount. It is submitted that the petitioner was not the Director of the company(s) and earlier he was serving in Hindustan Aeronautics Limited and after his retirement, on the request of one R. Choudhary on pro bono basis he joined the company and has singed on the debenture certificates. No amount of investment was received by him or any amount of the company was credited in his account. It is submitted that charge-sheet has already been submitted, as such, there is no further requirement of custodial interrogation. He is a Senior citizen of about 83 years old as of now. Learned ASGI for the CBI has vehemently opposed the prayer. It is submitted that petitioner in collusion with others has signed on the debenture certificates. Considering the submissions of learned counsel and the fact as discussed above, the anticipatory bail application is allowed. Hence, in the event of his arrest or surrender within a period of three weeks from the date of receipt of a copy of this order before the learned court below, the petitioner named above shall be released on bail on furnishing bail bond of Rs.50,000/- (Rupees Fifty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below and subject to the conditions that one of the bailors must be Income Tax Payee and, subject to the conditions laid down under Section 438(2) Cr.
